Please read these Terms and Conditions of Use (“Terms”) carefully before using our Website.
These Terms govern your access to and use of:

• online forms, self-assessments, scheduling links, and other online services we provide that link to these Terms (collectively with the Website, the “Online Services”)
If you do not agree to these Terms, do not use the Online Services.

IMPORTANT NOTICE ABOUT EMERGENCIES AND CRISES
THE ONLINE SERVICES ARE NOT AN EMERGENCY SERVICE AND ARE NOT MONITORED 24/7.

DEFINITIONS
“Content” means text, graphics, images, videos, audio, trademarks, logos, design, and other materials available through the Online Services.
“We,” “us,” “our,” or “New Chapter TMS” means New Chapter TMS.
“You” means anyone who accesses or uses the Online Services.
PRIVACY, COOKIES, AND TRACKING
Your use of the Online Services is also subject to our Privacy Policy and Notice of Privacy Practices, which explains how we collect, use, and share information, including through cookies and similar technologies (where enabled). If you are a Washington resident, additional rights and disclosures may apply to certain “consumer health data” as defined by Washington law. Please review our Privacy Policy for details and for how to exercise applicable rights.
NO MEDICAL ADVICE
All Content is for general informational and educational purposes only. Content is not medical advice and is not a substitute for professional evaluation, diagnosis, or treatment by a licensed clinician.
Do not use the Online Services to self-diagnose or to make decisions about treatment based solely on Content. Always seek the advice of a qualified health care provider with any questions you may have regarding a medical or mental health condition.
NO PROVIDER–PATIENT RELATIONSHIP THROUGH THE WEBSITE
Using the Online Services, including submitting forms, sending messages, or requesting information, does not create a provider–patient relationship with New Chapter TMS or any clinician.
A provider–patient relationship is established only after appropriate clinical intake and evaluation and our formal acceptance of you (or the patient you are acting for) as a patient, which typically includes completion of required consents and practice paperwork.
For example, Washington’s Uniform Telehealth Act provides that a practitioner–patient relationship may not be established through email, instant messaging, text messaging, or fax.
Do not rely on email, text messages, contact forms, or other online messages to establish care, receive clinical advice, or address urgent needs.
TELEHEALTH AND LOCATION LIMITATIONS
The Online Services may allow you to request a telehealth consultation or appointment.
Telehealth services (if offered and appropriate) are provided only to patients located in jurisdictions where our clinicians are licensed and authorized to practice at the time of the appointment.
You are responsible for providing accurate location information when requesting or attending a telehealth visit. We may require verification of your location and may cancel or reschedule if you are not located in an approved jurisdiction at the time of service.
MINORS AND AGE ELIGIBILITY
The Online Services are not directed to children under 13, and children under 13 may not use the Online Services.
If you are 13–17 years old, you may use the Online Services as permitted by applicable law. We encourage involving a parent or legal guardian when appropriate, but we recognize that Washington law may allow certain adolescents to seek outpatient behavioral health treatment without parental consent. We will follow applicable federal and Washington laws regarding consent, confidentiality, and communications with parents/guardians.
If you are under 13, you may not use the Online Services.
If you are a parent or legal guardian scheduling or submitting forms for a minor, you represent that you are authorized to do so and that the information you provide is accurate. Where appropriate, we may require additional verification of guardianship and consent.
SELF-ASSESSMENTS, SCREENERS, AND QUESTIONNAIRES
The Online Services may provide screening tools (for example, depression or anxiety questionnaires). Screening tools:
• do not provide a diagnosis,
• do not replace evaluation by a qualified clinician, and
• are not intended for emergency or crisis situations.
You are responsible for answering screening questions truthfully and accurately. If you are completing a screening tool for someone else, you represent that you are authorized to do so.
SCHEDULING AND THIRD-PARTY TOOLS
Some Online Services may be hosted or delivered through third-party platforms (for example, online scheduling or questionnaire tools). If you follow a link to a third-party website or tool, your use of that third-party service is governed by its terms and policies, not these Terms. We do not control third-party services and are not responsible for their availability, security, or content.
YOUR RESPONSIBILITIES WHEN CONTACTING US
Unless we explicitly provide a secure, clinical intake form or portal intended for health information, you agree not to submit sensitive or highly confidential medical information through general website forms or unsecured email.
You agree not to submit:
• emergency requests,
• threats of harm,
• illegal content,
• malware or malicious code, or
• sensitive or highly confidential medical information through general website forms or unsecured email.
You are responsible for ensuring that any information you submit is accurate, current, and submitted by you or by someone authorized to act on your behalf.
COMMUNICATIONS FROM US
If you provide contact information (such as phone number or email), you agree that we may contact you using that information to respond to your inquiry, provide scheduling information, and communicate about requested services.
If you provide a mobile number, you agree we may contact you by call or text for scheduling and administrative purposes; message and data rates may apply, and you can request to opt out of non-essential messages.
We do not guarantee response times, and you agree not to rely on Online Services communications for urgent or emergency matters.
INTELLECTUAL PROPERTY
The Online Services and Content are owned by New Chapter TMS or its licensors and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Online Services for your personal, non-commercial use, subject to these Terms.
You may not copy, reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any Content without our prior written permission, except as permitted by law.
Any third-party trademarks referenced on the Online Services are the property of their respective owners.
ACCEPTABLE USE
You agree not to:
• use the Online Services in a way that violates any law or regulation,
• attempt to gain unauthorized access to the Online Services or related systems,
• interfere with or disrupt the Online Services (including by introducing malware),
• scrape, crawl, or use automated means to access the Online Services without our permission,
• impersonate another person or misrepresent your identity, or
• use the Online Services to harass, threaten, or harm others.
We may restrict or block access to the Online Services for any use we reasonably believe violates these Terms or threatens the security or integrity of the Online Services.
TESTIMONIALS AND OUTCOMES
Any testimonials or patient experiences shared on the Online Services reflect individual experiences and are not a guarantee of any outcome. Mental health treatment outcomes vary by person.
WEBSITE AVAILABILITY AND CHANGES
We may modify, suspend, or discontinue any part of the Online Services at any time without notice. We may also update Content from time to time, but we do not promise that Content is complete, current, or error-free.
DISCLAIMER OF WARRANTIES
THE ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Online Services will be uninterrupted, secure, or free of errors, viruses, or other harmful components.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW CHAPTER TMS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE ONLINE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE ONLINE SERVICES WILL NOT EXCEED $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless New Chapter TMS from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Online Services, your violation of these Terms, or your violation of any law or the rights of another.
GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising out of or related to these Terms or the Online Services will be brought in the state or federal courts located in Spokane County, Washington, and you consent to the jurisdiction of those courts, except where prohibited by law.
SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
NO WAIVER
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last updated” date at the top indicates when these Terms were last revised. By continuing to use the Online Services after changes become effective, you agree to the revised Terms.
